CLÁUSULAS DE ESTILO PREVISTAS
Diversos autores como Flores Rueda (2014), González de Cossío (2011),
Abascal Zamora (2014), Vásquez del Mercado Cordero (2009) y Silva Silva
(2001) refieren o recomiendan utilizar cláusulas modelo o cláusulas de
estilo previstas por organismos de impartición de mecanismos alternativos
de solución de conflictos, como la Cámara de Comercio Internacional y la
Asociación Americana de Arbitraje, entre otros organismos que establecen
cláusulas de estilo escalonadas de mediación-arbitraje (Véase Figura No. 1).

In the event of any dispute arising out of or in connection with the present contract, the parties shall rst refer the
dispute to proceedings under the ICC Mediation Rules. If the dispute has not been settled pursuant to the said Rules
within [45] days following the ling of a Request for Mediation or within such other period as the parties may agree
in writing, such dispute shall thereafter be nally settled under the Rules of Arbitration of the International Chamber
of Commerce by one or more arbitrators appointed in accordance with the said Rules of Arbitration (International
Chamber of Commerce, s.f.).

If a dispute arises from or relates to this contract or the breach thereof, and if the dispute cannot be settled through
direct discussions, the parties agree to endeavor rst to settle the dispute by mediation administered by the American
Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration. Any unresolved
controversy or claim arising from or relating to this contract or breach thereof shall be settled by arbitration adminis
-
tered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on
the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. If all parties to the dispu-
te agree, a mediator involved in the parties’ mediation may be asked to serve as the arbitrator (American Arbitration
Association, 2013, pp. 33-34).
In the event of any controversy or claim arising out of or relating to this contract, or a breach thereof, the parties
hereto agree rst to try and settle the dispute by mediation, administered by the International Centre for Dispute
Resolution under its Mediation Rules. If settlement is not reached within 60 days after service of a written demand for
mediation, any unresolved controversy or claim arising out of or relating to this contract shall be settled by arbitration
in accordance with the International Arbitration Rules of the International Centre for Dispute Resolution (International
Centre for Dispute Resolution of the American Arbitration Association, 2011, p.4).
En caso de cualquier controversia o reclamación que surja de este contrato o que guarde relación con él o con su
incumplimiento, las partes acuerdan primero tratar de solucionar dicha controversia mediante mediación administrada
por el Centro Internacional para la Resolución de Disputas de conformidad con su Reglamento de Mediación Interna-
cional. Si las partes no logran llegar a un acuerdo dentro de los 60 días siguientes a la noticación de una solicitud de
mediación por escrito, cualquier controversia o reclamación que no haya sido resuelta será sometida a arbitraje admi-
nistrado por el Centro Internacional para la Resolución de Disputas de conformidad con su Reglamento de Arbitraje
Internacional (Centro Internacional de Resolución de Disputas de la Asociación Americana de Arbitraje, 2012, p.4).

If any dispute or difference of any nature between the parties shall arise pursuant to this Agreement, then such dispu-

Dispute Resolution: [_________] or such other organization which provides mediation services. The mediator shall be
agreed upon by the parties but failing such agreement within [twenty-eight days] of one party requesting the appoint-
ment of a mediator the mediator shall be appointed by the [President of the Law Society] of [country] at that time.
If not resolved by the procedure in 1.1 such dispute or difference shall be referred to a single arbitrator under the
[Rules of the Chartered Institute of Arbitrators/other] in [country] for resolution.
If not resolved by procedures in 1.1 or 1.2 then either party shall be at liberty to pursue such action and remedies as
it shall, at its sole discretion, decide in the circumstances subject to the terms of this Agreement (Fosbrook & Laing,
