Aspectos histórico-constitucionales de las libertades de conciencia, de religión y de culto en Colombia

Resumen

En el presente artículo de revisión, se abordará el reconocimiento de las libertades de religión, de culto y de conciencia, como resultado de incesantes luchas entre quienes monopolísticamente manejaban los hilos del poder espiritual –incluso el temporal– y aquellos que, orientados por conceptos distintos, pregonaban las ideas liberales desarrolladas vehementemente a partir de la Revolución Francesa de 1789. De igual forma, se analizará el proceso jurídico-constitucional que llevó a Colombia a poseer una Carta Magna donde se protegen las libertades y se reconoce la diversidad, como derecho inalienable del ser humano, sumado a la imperativa aplicación del principio de igualdad sobre todas las relaciones que con ocasión al ejercicio de los derechos y garantías fundamentales, surjan entre el Estado y los particulares, y entre estos.


Abstract

In the present article of review, there will be approached the recognition of the freedoms of religion, of worship and of conscience, as result of incessant fights between whom monopolisticamente were handling the threads of the spiritual power –enclosedly the temporary one– and those that, orientated by different concepts, were proclaiming liberal developed ideas vehement in way since the French Revolution of 1789. Also there was analyzed the juridical-constitutional process that led Colombia to possessing a Constitucion where the freedoms are protected and the diversity is recognized, as inalienable right of the human being, added to the imperative application of the beginning of equality on all the relations that with occasion to the exercise of the rights and fundamental guarantees, should arise between the State and individuals and between these.
