Constitutional aspects of the right to a healthy environment as a guarantee of fundamental rights in Colombia

This article studies the impact of the right to the environment in relation to fundamental rights, understanding that there must be a relationship between them, to guarantee the welfare of people. On the other hand, it studies the evolution of Colombian law in relation to the protection of the same right, understanding that the Political Constitution of Colombia of 1991 brings significant changes, and that the constitutional jurisprudence reaffirms its importance for social development. The research methodology would be qualitative, with a systematic and multidisciplinary approach to the study of the right to a healthy environment. With respect to the partial results of this research, the relationship between the right to a healthy environment and other fundamental rights, such as the right to life and human dignity, is evidenced and the constitutional relevance of environmental law in Colombia is highlighted. Finally, it is concluded that the right to the environment has a significant impact on the development of the human being and therefore has a direct effect on other fundamental rights, on the other hand, it can be interpreted that the Colombian legislation works in function of its protection, but all of them are in function of control and not of prevention.
