Prueba pericial en el delito de incesto: mirada desde la perspectiva judicial en la región caribe

Resumen

El presente artículo de investigación se centra fundamentalmente en la valoración de la prueba pericial en procesos penales por el delito de incesto, el cual se hace bajo un análisis de los diversos sistemas de valoración de la prueba, en la cual, se observa rigurosamente la importancia de la prueba científica en el proceso penal, bajo la perspectiva de un sistema acusatorio y con una mirada a la teoría de la pena, de tal suerte que esta propenda por el cumplimiento de los fines de prevención especial y protección al condenado.

Abstract
The present article of investigation centres fundamentally on the valuation of the expert test on penal processes for the crime of incest, which is done under an analysis of the diverse systems of valuation of the test, in which, is observed rigorously the importance of the scientific test in the penal process, under the perspective of an accusatory system and with a look to the theory of a sorrow, of such luck that this one should tend for the fulfillment of the ends of special prevention and protection to the reprobate.
